PUBLIC OFFER AGREEMENT
for ordering, purchase and delivery of goods

This Agreement is an official public offer (offer) by the Seller to conclude a contract for the sale of goods presented on the website olan.te.ua. The Agreement is considered concluded once the Buyer clicks the “Confirm Order” button on the checkout page and receives electronic order confirmation from the Seller.

  1. Definitions
    1.1. «Offer» — the Seller’s public proposal to conclude a distance sales contract on the terms set forth in this document.
    1.2. «Goods» or «Service» — the subject of the transaction selected by the Buyer on the website.
    1.3. «Online store» — the Seller’s website at www.olan.te.ua.
    1.4. «Buyer» — an individual (18+) or legal entity / sole proprietor placing an order.
    1.5. «Seller» — Sole Proprietor (FOP) Oleg Vavryk, operating under the laws of Ukraine.
  2. Subject of the Agreement
    2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer; the Buyer undertakes to pay for and accept the Goods under this Agreement.
    2.2. The Agreement is concluded upon the Buyer’s order submission and the Buyer’s receipt of electronic order confirmation from the Seller. At the Buyer’s request, the Agreement may be executed in a written form.
  3. Order placement
    3.1. Orders are placed by the Buyer via the checkout form on the website, by phone or by e-mail as indicated in the «Contacts» section.
    3.2. The Seller may refuse to process an order if provided information is incomplete or appears fraudulent.
    3.3. Mandatory information for order processing: full name, delivery address (if applicable), contact phone number; for legal entities — identification code/requisites.
    3.4. Item name, quantity, SKU and price are shown in the Buyer’s cart.
    3.5. If additional information is required and not provided, the Seller is not liable for improper execution of the order.
    3.6. Orders placed through the Seller’s operator require the same information as above.
    3.7. After order placement via operator, Buyer data is entered into Seller’s database.
    3.8. The Buyer is responsible for the accuracy of the provided information.
    3.9. By accepting the Offer the Buyer confirms: (a) having read and agreed to the terms; (b) consent to collection, processing and transfer of personal data for the purpose of order execution and accounting, including transfer to third parties necessary for order fulfillment. The Buyer is informed of their rights under the Ukrainian Law on Personal Data Protection.
  4. Price and Delivery
    4.1. Prices are set by the Seller and displayed on the site in UAH, VAT included.
    4.2. Prices may change; however, the price of a good that has been fully paid cannot be unilaterally altered by the Seller.
    4.3. Delivery cost is not included in the price and is paid according to the carrier’s tariffs.
    4.4. The Seller may provide approximate delivery cost upon request.
    4.5. Payment is considered made when funds are received on the Seller’s account.
    4.6. Payments are accepted as described in the «Payment and delivery» section.
    4.7. Upon receipt, Buyer must verify quantity, completeness and appearance of Goods in presence of the carrier’s representative.
    4.8. By signing the delivery receipt, Buyer (or representative) confirms absence of claims regarding quantity and external condition.
    4.9. Ownership and risk of accidental loss or damage pass to the Buyer upon receipt or upon transfer to the carrier, depending on delivery method.
  5. Rights and obligations of the parties
    5.1. Seller obligations: transfer goods in conformity with the Agreement and order; protect Buyer’s private data except as required for order performance or by law.
    5.2. Seller rights: unilaterally amend the Agreement and prices by publishing changes on the site. Changes become effective from publication.
    5.3. Buyer obligations: familiarize with Agreement and prices before accepting; provide accurate data necessary for order fulfillment.
  6. Returns
    6.1. Buyer may return non-food goods of proper quality within 14 days if unused and in original condition with tags and receipt. Items non-returnable are determined by applicable law.
    6.2. Refund for returns of goods of proper quality is processed within 30 calendar days from Seller’s receipt of returned goods if return conditions are met.
    6.3. Refunds are made by bank transfer to Buyer’s account.
    6.4. Return shipping for goods of proper quality to Seller’s address is paid by the Buyer.
    6.5. For defects discovered within warranty period Buyer’s claims are subject to the Law of Ukraine «On Consumer Protection». Time for remedy is counted from Seller’s receipt of the returned goods.
    6.6. Claims are considered upon presentation of documents required by law. Seller is not liable for defects arising after transfer due to Buyer’s misuse, third party actions or force majeure.
    6.7. No right to return individually made goods or items tailored to Buyer’s specifications.
    6.8. Returns are accepted via Nova Poshta, Ukrposhta, Meest Express or at the address provided in «Contacts».
  7. Liability
    7.1. Seller is not liable for damage caused by improper installation, use or storage of the product by the Buyer.
    7.2. Seller is not liable for delays or non-performance due to Buyer’s provision of inaccurate information.
    7.3. Parties bear liability in accordance with Ukrainian law.
    7.4. Parties are released from liability for force majeure events (war, natural disaster, fire, etc.); the affected party shall promptly notify the other party.
  8. Confidentiality and personal data protection
    8.1. By providing personal data during registration or order placement the Buyer consents to processing and transfer of such data for the purposes of order execution and accounting, without time limitation.
    8.2. Seller shall not disclose Buyer’s data except to contractors/third parties required for order fulfillment or as required by law.
    8.3. Buyer is responsible for keeping personal data up to date; Seller is not liable for consequences of outdated or inaccurate data.
  9. Miscellaneous
    9.1. This Agreement is governed by the laws of Ukraine.
    9.2. Disputes are to be resolved through negotiation or in court according to applicable law.
    9.3. Seller may amend the Agreement in accordance with clause 5.2.1 or by mutual consent.
